This paper begins with a discussion of the current legal definition of sex laid down in Corbett v Corbett. The implications of this test for three areas of the law, marriage, birth certificates and employment are then examined. Solutions from the United States of America and West Germany are studied and the suitability of similar solutions being transplanted into British law discussed.

Aveline examine d'abord le rapport entre théologie chrétienne et dialogue interreligieux, et l'évolution de la toute récente théologie des religions depuis Vatican II. L'intérêt de la relecture de Blondel dans cette perspective est d'abord de prévenir les facilités, impasses et illusions dans lesquelles la vieille apologétique s'était enferrée, et de donner les conditions d'un véritable dialogue. Pour dépasser les limites d’un pluralisme conçu comme simple (...) juxtaposition tolérante des opinions privées, la reprise de la thématique de la vérité est capitale, en quoi le maître d’Aix s’avère d’autant plus pertinent qu'il permet de poser philosophiquement le problème religieux. Permettant du même coup de tenir avec rigueur la distinction entre immanentisme exclusiviste et transcendance qui procure le salut, Blondel établit de manière féconde la distinction et le rapport entre philosophie et théologie. Aveline first examines the relationship between Christian theology and interreligious dialogue, and the evolution of the very recent theology since Vatican II. The interest in rereading Blondel in this perspective is first to point out the simplicity, the dead ends, and the illusions to which the old apologetics was bound, and to give the conditions for a true dialogue. To go beyond the limits of a pluralism understood as a simple juxtaposition that is tolerant of private opinions, the return to the theme of truth is capital, about which the master of Aix shows himself all the ore pertinent by posing the religions problem philosophically. While holding rigorously the distinction between exclusive immanentism and a transcendence that brings salvation, Blondel establishes, in a fertile way, the distinction and relationship between philosophy and theology. The central hypothesis of the collaboration between Language and Computing (L&C) and the Institute for Formal Ontology and Medical Information Science (IFOMIS) is that the methodology and conceptual rigor of a philosophically inspired formal ontology will greatly benefit software application ontologies. To this end LinKBase®, L&C’s ontology, which is designed to integrate and reason across various external databases simultaneously, has been submitted to the conceptual demands of IFOMIS’s Basic Formal Ontology (BFO). Malthus did not leave us with a systematic treatment of colonization, but from remarks scattered throughout his publications and correspondence it is possible to assemble a fairly coherent account of his views on the advantages and disadvantages of colonies, and on the reasons why some have failed and others succeeded. Included in these scattered remarks are some comparisons between his own views on colonies and those of Adam Smith. The question of the relationship between Malthus and Adam Smith is a (...) rather complex and subtle one, and cannot be given the full consideration it deserves in one short paper. But, as a general summary, it can be said that Malthus had a high regard for Smith and considered himself a follower and disciple of Smith, by contrast with Ricardo, James Mill, and McCulloch etc., whom he considered as exponents of a ‘New System of Political Economy”. His own Principles of Political Economy was conceived as a collection of ‘tracts or essays”, not as a new systematic treatise replacing the Wealth of Nations, Joseph Gamier in his article ‘Malthus” in the Dictionnaire de l'Economie Politique, 1852, saw that the title of the Principles was in fact a misnomer: ‘Malgré son titre, le livre sur les Principes n'est point un traité complet, mais seulement une collection de dissertations.” In what was probably intended as a criticism of Ricardo's Principles of Political Economy and Taxation, 1817, Malthus stated that the ‘present period … seems to be unpropitious to the publication of a new systematic treatise on political economy”, and, referring to Smith's work, stated that ‘the treatise which we already possess is still of the very highest value”. Nevertheless, despite professing his affiliation, Malthus did not hesitate to criticize Smith when he disagreed with him. He recognized that the Wealth of Nations contained ‘controverted points” and that it would require some ‘additions … which the more advanced stage of the science has rendered necessary”. (shrink)

Open peer commentary on the article “Exploring the Depth of Dream Experience: The Enactive Framework and Methods for Neurophenomenological Research” by Elizaveta Solomonova & Xin Wei Sha. Upshot: This commentary aims to sharpen the conceptual distinction between the breadth and the depth of dream experience. I discuss several possible readings and argue that the best one construes breadth and depth as distinct but complimentary research strategies distinguished not just by the kinds of evidence they rely on, but also by the (...) degree to which different types of data are integrated and focused on the same experiential episode. I identify promising candidates for depth approaches and challenges for future research. (shrink)

Medical decision making relies heavily on the notion of the quality of a person's life in providing a reason to utilize one therapy over another or to withhold certain therapies altogether. The concept of quality of life, however, lacks clear definition as well as consensus on its constitutive elements. ;Chapter one engages a basic controversy in the literature: whether 'quality of life' should be understood as a subjective concept, or whether objective "lists" can help us assess a person's quality of (...) life. Chapter two examines whether anthropological data might provide guidance. While it is often argued that anthropological data supports relativism, John Finnis argues that anthropological data supports universalism which, in turn, bolsters objectivist claims. I argue that anthropological data may plausibly be interpreted to support either subjective or objective accounts, and thus, does not settle our approach to quality of life. ;Chapter Three examines objective list theories, in particular those of Bernard Gert and John Finnis. I find Gert's account to be problematic because it seems incomplete. Finnis's criteria, too, seems ultimately indefensible. Thus, I conclude that while objectivist claims may offer insight into human values and motivations, existing accounts are flawed. Chapter Four examines subjective accounts of quality of life. I focus on "preference satisfaction" accounts. While these accounts provide intuitively plausible descriptions, they fall victim to a host of difficulties. Perhaps the best example of this is the "fleeting preferences" problem, which undermines our confidence in making life-and-death decisions on the basis of quality of life considerations. ;The concluding chapter offers that much progress can be made by understanding quality of life in terms of finding meaning in life. Thus, the quality of one's life is determined by how much purpose and meaning is found in that life. While this notion is not without its problems, it does capture the complex elements of the kinds of cases in which we are particularly interested, and combines some of the best features of both the objective and subjective accounts.
